SILENT AUCTION TERMS AND CONDITIONS (“TERMS AND CONDITIONS”)
By registering for and participating in this online silent auction (“Auction”), all bidders agree to the following Terms & Conditions.
1. Organiser
This Auction is conducted by the Australian Sea Lion Recovery Foundation (“ASLRF”, “we”, “our”, or “us”).

The following persons, and members of their immediate family (defined as a spouse, partner, parent, child, sibling, or any family member residing at the same residential address), are not eligible to participate in the Auction:

To participate in the Auction, all bidders must register through the official auction platform and provide:

The Auction consists of one donated item:
The item is offered and sold “as is” with no warranties, guarantees, exchanges, or representations regarding condition, framing condition, suitability, merchantability, or fitness for purpose beyond the description provided on the auction platform.
Images of the artwork are provided for illustrative purposes only. Actual colours, framing, dimensions, and presentation may vary slightly from digital representations.
While ASLRF endeavours to ensure descriptions and images are accurate and up to date, no warranty is given regarding the completeness or accuracy of descriptions or photographs.
All images of the artwork remain subject to copyright and may not be reproduced, copied, distributed, or used without permission from the copyright holder.

These Terms & Conditions are governed by the laws of New South Wales, Australia.
Any disputes arising in connection with the Auction shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

3. Eligibility
- Participation is open to individuals aged 18 years or older.
- All bidders must be legally capable of entering into binding contracts under applicable law.
- By registering to bid, participants confirm they are at least 18 years of age and legally entitled to participate in the Auction.
- Bidders may be located within Australia or internationally, subject to any applicable shipping, customs, or import restrictions.
The following persons, and members of their immediate family (defined as a spouse, partner, parent, child, sibling, or any family member residing at the same residential address), are not eligible to participate in the Auction:
- any person directly involved in the administration or conduct of the Auction; and
- any employee, director, or office bearer of the Australian Sea Lion Recovery Foundation.
ASLRF reserves the right to determine bidder eligibility at its sole discretion.
4. Registration Requirements
To participate in the Auction, all bidders must register through the official auction platform and provide:
- Full legal name
- Valid email address
- Phone number
- Residential or postal address
- Valid payment details
ASLRF reserves the right to refuse, suspend, or cancel any registration at its discretion.
5. Auction Item
The Auction consists of one donated item:
- An original framed artwork donated by Valerie Taylor.
The item is offered and sold “as is” with no warranties, guarantees, exchanges, or representations regarding condition, framing condition, suitability, merchantability, or fitness for purpose beyond the description provided on the auction platform.
Images of the artwork are provided for illustrative purposes only. Actual colours, framing, dimensions, and presentation may vary slightly from digital representations.

6. Bidding Process
- The Auction will run online for a period of four (4) weeks.
- All bids are binding once submitted.
- By placing a bid, the bidder acknowledges that the bid constitutes a binding and irrevocable offer to purchase the item if they are the successful bidder.
- No bids will be accepted after the official closing time.
- ASLRF reserves the right to reject, remove, or invalidate bids deemed fraudulent, erroneous, misleading, or inconsistent with these Terms & Conditions.
7. Winning Bidder
- The highest valid bid at the official closing time will be deemed the winning bid.
- If two identical bids are received, priority will be given to the bid submitted first according to the auction platform timestamp.
- ASLRF reserves the right to verify bidder information before confirming the winning bidder.
- If the winning bidder fails to complete payment within the required timeframe, ASLRF may offer the item to the next highest bidder or re-list the item at its discretion.
8. Payment Terms
- The winning bidder must complete payment within thirty (30) calendar days of the auction closing date.
- Accepted payment methods are:
- Credit/debit card: Visa, Mastercard, and American Express
Payments may be processed through third-party payment providers. Bidders may also be subject to the terms and conditions of those providers.
ASLRF does not store credit card details beyond payment processing requirements.
9. Refunds & Returns
- All sales are final.
- No refunds, exchanges, cancellations, or returns will be provided.
- Change of mind is not accepted.
To the maximum extent permitted by law, ASLRF accepts no liability for loss, dissatisfaction, damage, or expense arising from participation in the Auction or purchase of the artwork.
10. Shipping, Collection & Delivery
- Shipping, freight, insurance, packaging, customs duties, import taxes, brokerage fees, and any other delivery-related costs are the responsibility of the winning bidder unless otherwise agreed in writing.
- International bidders are responsible for complying with any import or customs requirements applicable in their jurisdiction.
- ASLRF is not responsible for delays, damage, theft, or loss occurring during shipping or transport once the artwork has been dispatched.
- Delivery arrangements will be coordinated directly with the winning bidder following payment confirmation.
11. Technical Issues
ASLRF is not responsible for:
- internet outages,
- platform errors,
- delayed bids,
- failed bid transmissions,
- technical malfunctions,
- interruptions,
- or any inability to access or use the auction platform.
12. Privacy
Personal information collected during registration and bidding will be used solely for:
- administration of the Auction,
- contacting bidders,
- payment processing,
- delivery coordination,
- and related fundraising communications.
Information will be handled in accordance with the Privacy Act 1988 (Cth) and applicable Australian privacy laws.
Bidders may opt out of future communications from ASLRF at any time.
13. Right to Modify or Cancel
ASLRF reserves the right to:
- amend these Terms & Conditions,
- extend or shorten the Auction period,
- withdraw the artwork,
- suspend bidding,
- cancel the Auction,
- or otherwise modify the Auction process at any time if reasonably required.
14. Disputes
- Any dispute relating to bidding, payment, ownership, interpretation of these Terms & Conditions, or operation of the Auction will be determined by ASLRF in its sole discretion.
- ASLRF’s decision is final and no correspondence will be entered into.
15. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.

Silent Auction Rules

2. Multiple Bids
Participants are allowed to bid on an item multiple times. Each new bid must be higher than the previous bid by at least the minimum increment.
3. Finality of Bids and Sales
All bids and sales are final. No refunds or exchanges will be provided.
4. Payment Obligations
Winning bidders agree to pay in full at the end of the auction. Payment must be completed by 11 July 2026.
5. Age Restrictions
Bidders must be at least 18 years old to participate in the auction. Bidders must meet these requirements to bid on and win these items.
6. Assumption of Risk
Bidders assume all risks related to the auction items and the bidding process.
7. Item Changes
Items may be withdrawn without notice. We apologise for any inconvenience this may cause.
8. Determination of Winners
The highest bid at the end of the auction period will determine the winner of the item.
9. As-Is Condition
All items are sold as-is, with no guarantees or warranties. Please review item descriptions and conditions carefully.
